I believe that case specifically referred aptitude tests and their conditional requirements concerning job placement, not blatant discriminations practices like companies bragging and openly declaring they are hiring less white people and more POC's, just because. Those are the cases where it is hard to deny the practice isn't blatantly racists. Even that decision required plaintiffs with the burden of proof, requiring that they show specific business practices and their impact. This could easily be done in these modern occurrences.
